CASYN Terms of Use

These terms are the agreement between you and Ashorin Technologies for using CASYN. Please read them. The most important points are in section 3 (what CASYN is and is not) and section 4 (your responsibility for patient information).

1. Agreeing to these terms

By installing or using CASYN you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use CASYN. If you use CASYN on behalf of a clinic or hospital, you confirm that you are allowed to accept these terms for it.

2. Who may use CASYN

CASYN is made for healthcare practitioners — for example dentists, doctors and other clinicians — who are registered, or in training, with the body that regulates their profession where they work, and for the people who work with them in their practice, such as assistants, nurses, technicians and front-desk staff. You must be at least 18 years old.

When staff use CASYN for a practitioner, they act on that practitioner's instructions, and the practitioner remains responsible for how patient information is recorded and used (section 4).

3. What CASYN is — and what it is not

CASYN is a tool to capture, organise, annotate, back up and share your clinical photos, videos, documents, notes and follow-up reminders.

CASYN is not:

• a medical device, and it does not diagnose, treat or recommend treatment;

• a replacement for your professional judgement;

• an official medical record system, hospital information system or electronic health record, unless you decide to use it as part of your own records and that is allowed where you practise;

• a telemedicine or emergency service.

Some features fill in or suggest information automatically — for example filling in patient details from a photo, voice dictation, and any automated or AI-assisted features we add in future. These can make mistakes. Always check what CASYN has filled in or suggested before relying on it. Reminders depend on your phone's settings (for example battery saving) and may not appear in every situation — do not rely on CASYN alone for time-critical patient care.

4. Your patient information and your responsibilities

Everything you add to CASYN — patient details, photos, videos, notes and documents (“your content”) — belongs to you (and, where the law says so, to your patient). We do not receive it, own it or use it.

Because you decide what to record and why, you are responsible for it. In particular you agree to:

• Get consent. Obtain your patient's informed consent, as your law and professional rules require, before photographing or recording them, and before sharing, publishing or teaching with their records.

• Follow your law and professional rules. Comply with the data-protection and health-privacy laws of the place where you practise, and with the rules and ethics of the professional body that regulates you.

• Keep records as long as required. If your law requires you to keep patient records for a set period, it is your responsibility to keep them (for example by keeping backups) for that period.

• Protect access. Keep your phone locked, use CASYN's app lock if others can reach your phone, and keep your Google account secure.

• Share carefully. Anything you export or share leaves CASYN's protection. Remove identifying details when they are not needed.

5. Your licence to use CASYN

We give you a personal, non-exclusive, non-transferable licence to install and use CASYN on devices you own or control, for your professional work, under these terms.

You sign in to CASYN with your own Google account. Keep it secure; you are responsible for what is done in CASYN through your account and on your phone.

6. Things you must not do

• use CASYN for anything unlawful, or to store content you have no right to hold;

• copy, modify, decompile or reverse-engineer the app, except where the law allows it;

• try to get around its security, encryption or app lock, or use it to harm others;

• sell, rent or redistribute CASYN, or remove our names, logos or notices;

• use CASYN's name or logo to suggest that we endorse you or your work.

7. Google and other services

CASYN uses services run by Google: sign-in, Google Drive (for backups), Google Calendar (read-only, for holidays and events), Firebase (usage statistics and crash reports) and Google Play (installation and updates). Your use of those services is also governed by Google's own terms and policies. Backups use your own Google Drive storage and count toward its limit. We are not responsible for these services being unavailable, changing, or failing.

8. Backups and data loss

We take great care to make backups and restores reliable, but no software is perfect and phones can be lost, damaged or reset. You are responsible for keeping your backups up to date.

• Backups are linked to the Google account used to make them. Keep access to that account — without it, backups cannot be restored.

• If you set a backup password and forget it, we cannot recover it, and those backups cannot be opened.

• Deleted cases are kept in Trash for 30 days and then removed permanently.

• Uninstalling CASYN or clearing its storage deletes the data on that phone. The backup folder on your phone and your Drive backups are not deleted.

9. Price and paid plans

CASYN is free today. We may start charging in future for some or all features, including features that are free today. If we do, we will tell you in the app before the change takes effect, prices and what each plan includes will be shown clearly before you buy, and payment will be handled by Google Play. Any extra terms for paid plans (such as renewal and refunds) will be shown to you then. You will never be charged unless you choose to buy.

10. Changes to CASYN

We improve CASYN regularly, so features may be added, changed or removed. Some updates may be required to keep using the app safely. Features we label as “beta”, “preview” or “experimental” are still being tested and may change or be withdrawn. If we ever decide to stop offering CASYN, we will give at least 60 days' notice in the app so you can make sure your data is backed up. Your records remain on your phone and in your own backups either way.

11. Ownership

CASYN, its design, code, name and logo belong to Ashorin Technologies and are protected by law. These terms do not give you any rights to them beyond using the app. Your content is yours (section 4). If you send us feedback or ideas, we may use them to improve CASYN without owing you anything.

CASYN includes open-source software, listed under About → Open-source licences, each under its own licence.

12. No guarantee

CASYN is provided “as is” and “as available”. As far as the law allows, we make no promises that it will be uninterrupted, error-free, or suitable for any particular clinical, legal or record-keeping purpose.

13. Limits on our responsibility

As far as the law allows:

• we are not responsible for clinical decisions, treatment outcomes or professional consequences connected with your use of CASYN;

• we are not responsible for loss of data, loss of profit or reputation, or any indirect or consequential loss;

• our total responsibility to you for any claim is limited to the amount you paid us for CASYN in the 12 months before the claim or ₹1,000, whichever is higher.

Nothing in these terms limits responsibility that cannot be limited by law, or your rights as a consumer that cannot be waived.

14. Your responsibility to us

If someone — for example a patient or a regulator — makes a claim against us because of your content, or because you broke these terms or the law while using CASYN, you agree to cover our reasonable costs and losses from that claim.

15. Ending this agreement

You can stop using CASYN at any time by uninstalling it. We may stop providing CASYN to you if you seriously break these terms. Sections 4, 8, 11, 12, 13, 14, 16 and 18 continue to apply after the agreement ends.

16. Law and disputes

These terms are governed by the laws of India. If a dispute arises, please email us first — most problems can be solved that way. If it cannot be solved within 30 days, the courts at Kolkata, West Bengal, India will have exclusive jurisdiction. If you live outside India, you may also have rights under your local law that these terms do not take away.

17. Changes to these terms

We may update these terms. We will change the date at the top and show you the change in the app before it applies. If you keep using CASYN after that, you accept the new terms.

18. General

• Whole agreement. These terms and the Privacy Policy are the whole agreement between you and us about CASYN.

• If one part fails. If a court finds any part of these terms unenforceable, the rest still applies.

• No waiver. If we do not enforce a term straight away, we can still enforce it later.

• Transfer. We may transfer this agreement to a company we set up to run CASYN, or to anyone who takes over CASYN; your rights under these terms will not be reduced by it. You may not transfer it.

• Events outside our control. We are not responsible for delays or failures caused by events we cannot reasonably control, such as outages of Google services, networks or power, or natural events.

• How we contact you. We will tell you about important changes in the app, or by email if you have written to us.

• Language. If these terms are translated, the English version applies.

• Google Play. These terms are between you and Ashorin Technologies, not Google. Google Play's own terms also apply to downloading the app.
